RECUALIZER PRIVACY POLICY

Recualizer Ltd. (“Recualizer” or “we/us”) is committed to protecting the privacy of all the users of our services (“you” or “User”) which includes Candidates (individuals creating a candidate profile) and Companies. This Privacy Policy explains our practices regarding the use of personal data collected and processed through our services, which include our website at https://recualizer.com/ (the “Website”).

A. User Consent

By completing and submitting your personal data to us, via any online registration or other forms presented on our Services, you declare to have read and accepted the terms of this Policy. Without prejudice to the foregoing, you expressly and unequivocally consent to the collection and processing of your personal data (as identified below) by us, in one or more files under the responsibility of Recualizer, in accordance with the indicated purposes and this Policy.

In particular, as a candidate you expressly consent to our processing and storing of your data for the creation of your personality assessment (creating your Recualizer Profile) based upon the projective personality assessment test, and its communication to third parties in accordance with your instructions.

If you do not wish to receive commercial information about our and other services (defined below), you can expressly opt out by sending a notification to hello@recualizer.com or by clicking the unsubscribe link in our email communications.

B. Data collection

Registration.

On registering for use of our Services, we will collect the following personal data:
For Candidates: name, surname, telephone number, email address, social security number, username and password, company name and location, moving/relocation options, linkedIn or facebook profile. Note that If the Candidate is only taking the test without setting up a Recualizer account, we will only collect your full name, email address and store these with your test results.
For Companies: name, surname, title, company name and email address
These data are obligatory and if they are not provided, an account cannot be created. In accordance with our terms you warrant that you only provide data relating to you (and/or the company where you work) and shall indemnify us for any loss or damage we suffer for breach of this warranty.

Use of our Services.

On using our Services, we may collect the following data that may be associated with your account: internet protocol (“IP”), connection times, activity, communications and other similar types of data.

Recualizer Profile report.

Once you have passed the Recualizer test, we will also provide to you and store your professional personality report.

Prohibited data.

In all events, it is forbidden to submit to us or upload to the Services any data that contains sensitive data that is relative to identifiable persons such as: your and or third party’s racial origin, membership in a trade union, religion, ideology and sexual life, your and or third party’s health, unless it proves necessary in order to assert any handicap or disability situation for labour purposes; or your and or third party’s relative to the commission of criminal offences or proceedings and associated penalties or fines.

You are responsible for the accuracy of the information you provide to us and you are expected to update any information that is relevant for the user statistics. In return, you will be given access to certain statistics based on the aggregate data from all Recualizer users.

C. Data use

General.

We use your personal data (both candidates’ and companies’) to:

If you are a Candidate, we will also use your personal data, which includes your Recualizer profile and test results, to communicate it to Companies which you have authorised, and to reply to job offers upon your request. We may also use this data to suggest any types of job for which your profile corresponds, at your option.

Aggregate information.

Anonymous user information will be used to generate statistics and comparison data for the benefit of all our users. It can also be used in aggregate for marketing purposes, and forwarded to Recualizer business partners and customers.

Recualizer will be using Google Analytics and Heap Analytics in analysing and using your personal data as contemplated in this Privacy Policy. This is done in order to analyse the core personality qualities that needed for certain positions and give some statistics.

D. Disclosure

We treat your personal data with strict confidentiality in accordance with applicable law. However we may disclose your data as follows:

Except as stated above, you are responsible for the publication or other disclosure of your Recualizer profile report (e.g. on LinkedIn or other online platforms, or in non-digital format).

E. Recualizer as Data Processor

We are data controller of your account information and we shall process this information for providing our Services to you and other users in accordance with this policy.

Candidates, however, have control over their Recualizer Profile Report, and we only process this data on their behalf and according to their instructions and in accordance with applicable privacy law (as “Data Processor”).

To the extent that we are such Data Processor, we shall:

Upon the expiry or termination of your account (whether by us or by you), or upon your request, we will cease any and all processing of your Recualizer Profile Report you have submitted to us and will destroy or return it to you. We shall also destroy or return to you any other personal data relating to you, except as required by law (e.g. for accounting or tax purposes).

You authorise us to subcontract hosting of the Recualizer Profile Report within our Services to a third party processor if we reasonably consider such processing necessary to the performance of the Services (e.g. our hosting company, which is currently Amazone AWS – Location - Irland). We will notify you of any changes.

F. User Rights

You have the right to access, rectify, erase, block and oppose any processing of your personal data. Moreover, you may at any time withdraw your consent to the processing of your personal data and information. This withdrawal will not have retroactive effects but may prevent providing the Services. The above is without prejudice to provisions of UK applicable law enabling conservation of data for the purpose of defending our responsibility and complying with mandatory legal obligations. G. General

We reserve the right to amend the terms of this Privacy Policy and will notify you by providing a clear notice of these changes by email or on our website, and in this Privacy Policy. If you continue to use our Service after such update, you will be deemed to accept the new terms. If you do not accept the update, please notify us and we will terminate your account and remove any of your personal data (except as required to be maintained for legal purposes), and you will not be able to continue to use our Services.

Unless a specific local regulation sets forth to the contrary, the Privacy Policy is governed by the laws of England and Wales.
